Anti-Spam Policy

Jasnelvud is committed to maintaining a communication environment that is respectful, lawful, and free from unsolicited or abusive messaging. This Anti-Spam Policy describes the standards we apply to all communications sent through or in connection with our platform, and the obligations of users who use our services to communicate with others.

1. Scope and Application

This policy applies to all users of the Jasnelvud platform, including registered learners, instructors, administrators, and any third party who accesses or uses our services to send electronic communications. It covers all forms of outbound messaging facilitated by or originating from the platform, including but not limited to email notifications, course announcements, direct messages, and marketing communications.

2. Definition of Spam

For the purposes of this policy, spam refers to any unsolicited, bulk, or deceptive electronic communication sent without the recipient's prior consent or in violation of applicable communication standards. This includes, but is not limited to:

  • Unsolicited commercial messages sent in bulk to individuals who have not opted in to receive them
  • Messages with misleading, falsified, or obscured sender information
  • Communications with deceptive subject lines or headings that misrepresent the content
  • Repetitive or excessive messages sent to the same recipient without a legitimate purpose
  • Messages that contain or promote malware, phishing attempts, or fraudulent schemes
  • Harvested or purchased contact lists used for unsolicited outreach
  • Any communication designed to circumvent unsubscribe mechanisms or opt-out requests

3. Consent and Permission-Based Communication

All marketing and promotional communications sent through our platform must be based on a clear, affirmative, and documented consent from the recipient. Consent must be freely given, specific, informed, and unambiguous. Pre-ticked boxes, implied consent, or bundled consent are not considered valid under this policy.

3.1 Obtaining Consent

Users who send communications through our platform are responsible for obtaining and retaining evidence of consent prior to sending any message. Consent records should include the date, method, and scope of the permission granted by the recipient.

3.2 Transactional Communications

Transactional messages — such as account confirmations, password resets, payment receipts, and course access notifications — do not require prior marketing consent, as they are necessary for the delivery of the service. However, these messages must not contain promotional content that goes beyond the scope of the transactional purpose.

4. Sender Identification Requirements

All communications sent through or associated with Jasnelvud must clearly and accurately identify the sender. The following requirements apply:

  • The sender's name or organization must be clearly stated and must not be falsified or obscured
  • A valid reply-to address or contact mechanism must be included
  • The physical or registered address of the sending entity must be included in commercial messages where applicable
  • Messages must not use domain names, email addresses, or display names that impersonate other entities

5. Opt-Out and Unsubscribe Mechanisms

Every promotional or marketing communication sent through our platform must include a clear, functional, and easy-to-use mechanism for recipients to opt out of future communications. The following standards apply:

5.1 Opt-Out Requests

Unsubscribe requests must be honored promptly and without requiring the recipient to take unnecessary steps. Recipients must not be required to log in, pay a fee, or provide additional personal information solely to unsubscribe.

5.2 Processing Time

Opt-out requests must be processed within a reasonable timeframe. Once a recipient has unsubscribed, no further promotional communications may be sent to that address for the category of messages from which they opted out, unless the recipient subsequently provides fresh consent.

5.3 Platform-Level Opt-Out

Jasnelvud maintains its own suppression lists and unsubscribe preferences at the platform level. Users of the platform may not override or bypass these platform-level opt-out settings.

6. Prohibited Practices

The following practices are strictly prohibited on the Jasnelvud platform:

  • Sending or facilitating the sending of unsolicited bulk messages of any kind
  • Using automated tools, bots, or scripts to send messages without prior consent
  • Spoofing sender addresses or headers to disguise the origin of a message
  • Importing or using contact lists obtained through scraping, purchasing, or any method that does not reflect genuine opt-in consent
  • Sending messages that contain false or misleading claims about products, services, or the sender
  • Attempting to bypass spam filters, blacklists, or platform-level communication controls
  • Engaging in any form of phishing, smishing, or social engineering through the platform's communication tools
  • Sending content that is harassing, threatening, or abusive in nature

7. Platform Responsibilities

Jasnelvud takes the following measures to prevent spam and protect users from unsolicited communications:

  • Monitoring outbound communication patterns for signs of bulk or abusive sending behavior
  • Maintaining and enforcing platform-level suppression and unsubscribe lists
  • Implementing technical controls to detect and limit automated or suspicious messaging activity
  • Reviewing and acting on spam complaints submitted by users or reported through third-party feedback loops
  • Suspending or terminating accounts found to be in violation of this policy

8. User Responsibilities

Users who utilize Jasnelvud's communication features are solely responsible for ensuring that their messaging practices comply with this policy and with all applicable laws and regulations in the jurisdictions where their recipients are located. By using the platform's communication tools, users represent and warrant that:

  • They have obtained valid consent from all recipients prior to sending promotional communications
  • Their contact lists are accurate, up to date, and lawfully obtained
  • They will honor all opt-out and unsubscribe requests promptly
  • Their messages comply with the content and identification requirements set out in this policy

9. Reporting Spam

If you receive a communication that you believe violates this policy, or if you suspect that our platform is being used to send spam, we encourage you to report it to us. When submitting a report, please include the full content of the message, the sender's address or username, the date and time the message was received, and any other relevant details that may assist our investigation.

10. Consequences of Violation

Violations of this Anti-Spam Policy may result in the following actions, depending on the nature and severity of the breach:

  • Immediate suspension of the user's ability to send communications through the platform
  • Temporary or permanent account suspension or termination
  • Removal of content or communications associated with the violation
  • Reporting of the activity to relevant authorities or industry bodies where required
  • Legal action where the violation causes harm or constitutes a criminal offense

Jasnelvud reserves the right to determine, at its sole discretion, whether a violation has occurred and what action is appropriate in response.

11. Third-Party Services and Integrations

Where users integrate third-party tools, email service providers, or automation platforms with their Jasnelvud account, they remain fully responsible for ensuring that those integrations comply with this policy. Jasnelvud is not liable for spam or unsolicited communications that originate from third-party systems connected to a user's account.

12. Changes to This Policy

We may update this Anti-Spam Policy from time to time to reflect changes in our practices, technology, legal requirements, or industry standards. When we make material changes, we will update the date at the top of this document. Continued use of the platform following any update constitutes acceptance of the revised policy. We encourage users to review this policy periodically.
